Who we are

falconvid.ai (our website) and the FalconVid application at app.falconvid.ai are operated by Digital Global Assistance LLC, a limited liability company registered in the State of Wyoming, United States, under filing ID 2025-001810394, with its registered address at 30 N Gould St Ste R, Sheridan, WY 82801, United States ("we", "our" or "us"). We operate under the brand FalconVid. Digital Global Assistance LLC is the controller of your personal data. We take your privacy very seriously. Please read this privacy policy carefully as it contains important information on who we are and how and why we collect, store, use and share any information relating to you (your personal data) in connection with your use of our website and services. It also explains your rights in relation to your personal data and how to contact us or a relevant regulator in the event you have a complaint. We are the controller of your personal data. Because we serve users worldwide, we handle personal data in accordance with the data protection laws that apply to you, which may include the General Data Protection Regulation in the EU/EEA and the UK (GDPR / UK GDPR), the Brazilian General Data Protection Law (LGPD), and United States privacy laws (including the California Consumer Privacy Act, as amended, where applicable). Given the nature of our services, we do not expect to collect the personal data of anyone under 13 years old. If you become aware that a person under 13 has shared personal data with us, please let us know so we can delete it.

What this policy applies to

This privacy policy relates to your use of our website and services only. Throughout our website we may link to other websites owned and operated by trusted third parties. Those third-party websites may gather information about you in accordance with their own separate privacy policies. Personal data we collect about you

The personal data we collect depends on how you use our services. We may collect and use the following: • your name and contact information, including email address and, where you provide it, telephone number and country; • your account details, such as username and login credentials (stored only as a salted hash, never in plain text); • your billing status, transaction history and payment-method information (card data is handled directly by our payment processor — we do not store your full card number); • information to help verify your identity and prevent fraud, including data received from Google when you sign in with Google (name, email, verified-email flag and account identifier); • the content you submit when using our services (such as topics, prompts, scripts, instructions, channel selections and uploaded materials), the outputs we generate in response, and related interaction data (including logs, usage patterns and configuration preferences); • where you connect a YouTube or Meta (Facebook/Instagram) account, the authorisation tokens and the minimum channel/page information needed to publish on your behalf to your own channels; • your marketing preferences and your contact history with our support team; • technical and usage data about how you access and use our website and systems, such as IP address, device and browser type, pages viewed, actions taken and timestamps; • information you provide when joining a waitlist, early-access or promotional programme. You must provide the personal data needed to create an account and use the services, unless we tell you a field is optional. • the session credentials of the social media accounts YOU choose to connect (for example, TikTok, Instagram, Facebook, Rumble, Suno or CapCut/Dreamina session cookies), stored encrypted and used only to publish your videos to your own account; you can disconnect them at any time, which deletes them from our servers;

How your personal data is collected

We collect personal data from you: (a) directly, when you register, contact us, subscribe, generate content, connect an account, respond to surveys or take part in promotions; (b) automatically, through cookies and similar technologies as you use our website (see "Cookies and other tracking technologies" below); and (c) from third parties, such as our payment processor (billing status) and, where you sign in with Google, your Google profile.

How and why we use your personal data

Under data protection law, we only use your personal data where we have a proper reason to do so: to perform our contract with you or take steps at your request before entering into a contract; to comply with our legal and regulatory obligations; where you have given consent; or for our legitimate interests (or those of a third party) that are not overridden by your rights. Special category data

Certain data is treated as "special category" (for example data revealing racial or ethnic origin, political opinions, religious beliefs, trade union membership, biometric or genetic data, or data concerning health, sex life or sexual orientation) and receives additional protection under data protection law. We do not knowingly collect or process special category data, and it is not required to provide our services. You must not input or upload special category data. We recognise you might do so inadvertently (for example within a prompt or uploaded material), and we have measures in place to handle such data securely. If you become aware that special category data has been shared with us, please let us know so we can delete it.

Marketing

We may send you updates about our services, offers and content by email where permitted. Where we rely on legitimate interests we do not need your consent; if the law requires consent, we will ask for it separately and clearly. You can opt out of marketing at any time by using the unsubscribe link in any marketing email or by contacting us at help@falconvid.ai. Opting out does not stop service and transactional messages that are necessary to operate your account. We never sell your personal data or share it with third parties for their own marketing.

Who we share your personal data with

We share personal data only with parties that help us run our services, and only as needed. We require them to protect your data and to use it solely for the purposes we specify. We may also share data with our professional advisers, auditors, and with law-enforcement, courts, regulators or public authorities where we are legally required to do so or where disclosure is necessary and appropriate. How long your personal data will be kept

We will not keep your personal data for longer than necessary for the purposes for which it is processed, including to satisfy legal, tax, accounting or reporting requirements. For example, we keep account information for as long as you have an account; we keep correspondence for a reasonable period to manage your request; and we keep certain technical logs and usage data for limited periods to maintain the security and performance of our platform. Billing records are kept for the periods required by law. If you delete your account, we will delete or anonymise your data, except where we must retain certain information to comply with legal obligations, to establish, exercise or defend legal claims, or to detect and prevent fraud or misuse. Where data is retained for such reasons, access to it will be restricted. You can request deletion of your account at any time.

International transfers

Our infrastructure and some of our providers are located in the United States, and it may be necessary to transfer your personal data to countries outside your own, which may have different data protection laws. Where we transfer personal data internationally, we do so on the basis of an adequacy decision or, where that is not available, appropriate safeguards recognised by applicable law (such as standard contractual clauses), together with enforceable rights and effective remedies for you. Any change to the destinations or transfer mechanisms we rely on will be notified in accordance with "Changes to this privacy policy" below.

Cookies and other tracking technologies

A cookie is a small text file placed on your device when you use our website. We use cookies and similar technologies to recognise you and your device, keep you signed in, remember your preferences and measure usage. Your rights

Depending on where you live, you generally have the following rights, which you can usually exercise free of charge: • Access — to be provided with a copy of your personal data; • Correction — to have us correct any mistakes in your personal data; • Erasure — to have us delete your personal data in certain situations; • Restriction — to have us restrict processing in certain circumstances; • Portability — to receive your personal data in a structured, commonly used, machine-readable format and/or have it transmitted to a third party; • Objection — to object at any time to processing for direct marketing, and in certain other situations to our use of your data based on legitimate interests; • Withdrawal of consent — where we rely on your consent, to withdraw it at any time (this does not affect processing carried out before withdrawal); • Rights relating to automated decision-making — we do not make decisions producing legal or similarly significant effects about you based solely on automated processing. Depending on your jurisdiction you may also have the right not to be discriminated against for exercising these rights (for example under US state privacy laws). To exercise any right, email us at help@falconvid.ai with enough information to identify you and details of the right you want to exercise. We will respond within the time required by applicable law, and you can delete most of your content directly within the app.

Keeping your personal data secure

We use appropriate technical and organisational measures to prevent personal data from being accidentally lost, or used or accessed unlawfully. We limit access to your personal data to those with a genuine business need, under a duty of confidentiality; we use encryption in transit, hashed passwords, access controls, isolation between accounts, and signed webhook verification for payments; and we never retain your full card details (our payment processor securely handles the information needed to process your transaction). We also have procedures to deal with any suspected data security breach and will notify you and any applicable regulator where we are legally required to do so.

Browser extension (FalconVid for YouTube™)

We offer a Chrome browser extension that displays, on YouTube channel and video pages, public data and estimates computed by FalconVid. From version 1.2 onwards, it also lets you connect your own social media accounts so that FalconVid can publish your videos for you. What the extension processes: • the public identifiers of the YouTube channels you visit (for example, the channel ID) are sent to our servers to query our database and compute the estimates — this only happens after you enable automatic analysis in the extension itself, and can be turned off at any time in the extension popup; • if you connect your FalconVid account, a restricted access token (valid only for extension features) is stored locally in your browser to sync your favorites and the history of channels you looked up; • when YOU ask to connect a social media account, the extension reads the session cookies of that specific site — TikTok, Instagram, Facebook, Rumble, Suno or CapCut/Dreamina, depending on the account you chose — right after you log in to it. About reading session cookies, in detail: • the cookie-reading permission is OPTIONAL and is not granted at install time. It is requested at the moment you click to connect the account, on a screen inside the extension that explains what will happen, and you may decline; • we read only the cookies of the site you are connecting in that request, one site at a time. The extension carries no list of sites: it asks our server which domain to read, for that specific, single-use request. Cookies from any other site are never read; • the captured session is sent to FalconVid over HTTPS, stored encrypted, and used exclusively to publish YOUR videos to YOUR account. It is never sold, never shared with third parties and never used for advertising; • your password never passes through FalconVid. You log in directly on the site, in your own browser; • you can disconnect the account at any time on the FalconVid Platforms screen, which deletes the stored session from our servers. Uninstalling the extension also removes the permission. What the extension does NOT do: it does not collect your general browsing history, does not read the content of other pages, does not inject ads, and does not sell data to third parties. All data travels exclusively over HTTPS. Uninstalling the extension removes the token from your browser; you can also revoke access by logging out of your FalconVid account.

How to complain

Please contact us first at help@falconvid.ai if you have any concern about our use of your personal data, so we can try to resolve it. You also have the right to lodge a complaint with the data protection authority in your country (for example, in the EU/EEA your local supervisory authority; in the UK the Information Commissioner's Office; in Brazil the ANPD).

Changes to this privacy policy

We may change this privacy policy from time to time. When we make material changes, we will update the "last updated" date and, where appropriate, notify you via our website or by email.
